Using this site, the User agrees to comply with all TERMS AND CONDITIONS. The right to use the site is personal to the User and is not transferable to any other person or entity. The User shall be responsible for protecting the confidentiality of their password(s) – if any. The User acknowledges that, although the internet is often a secure environment, sometimes there are interruptions in services or events beyond the Company’s control. The Company shall not be responsible for any data lost while transmitting information on the internet.

While it is the Company’s objective to make the site accessible 24 hours a day, 7 days a week, the site may be unavailable from time to time for any reason, including, without limitation, routine maintenance. You understand and acknowledge that due to circumstances both within and outside of the control of the Company, access to the site may be interrupted, suspended or terminated from time to time. 

The Company shall have the right to change or discontinue any aspect or feature of the site, including, but not limited to, content, hours of availability and equipment needed for access or use. Further, the Company may discontinue disseminating any information or category that may change or eliminate any transmission method and may change transmission speeds or other signal characteristics.

We reserve the right to refuse service to anyone for any reason at any time.

You understand that your content (not including credit card information) may be transferred unencrypted and involve 

(a) transmissions over various networks, and

(b) changes to conform and adapt to the technical requirements of connecting networks or devices.

Credit card information is always encrypted during transfer over networks.

By agreeing to these Terms of Service, you represent that you are at least the age of majority in your state of residence and have given us your consent to allow any of your minor dependents to use this site.

You may not use our products for any illegal or unauthorised purpose, nor may you, in the use of the service, violate any laws in your jurisdiction (including but not limited to copyright laws).

A breach or violation of any of the Terms will result in an immediate termination of your Services.

Considering your use of the site, you represent that you are of legal age to form a binding contract and are not a person barred from receiving services under the laws applicable in India. We reserve the right to refuse any order you place with us. In our sole discretion, we may limit or cancel quantities purchased per person, household or order. These restrictions may include orders placed by or under the same customer account, credit card, and/or orders using the same billing and/or shipping address. If we make a change to or cancel an order, we may attempt to notify you by contacting the e‑mail and/or billing address/phone number provided at the time of order was placed. We reserve the right to limit or prohibit orders that, in our sole judgment, appear to be placed by dealers, resellers or distributors.

You agree to provide current, complete and accurate purchase and account information for all purchases made on our Site. You agree to promptly update your account and other information, including your email address, credit card numbers, and expiration dates, so that we can complete your transactions and contact you as needed.

We may provide you with access to third-party tools over which we neither monitor nor have any control nor input.

You acknowledge and agree that we provide access to such tools” as is” and “as available” without any warranties, representations or conditions of any kind and endorsement. We shall have no liability whatsoever arising from or relating to your use of optional third-party tools.

Any use by you of optional tools offered through the site is entirely at your own risk and discretion. You should ensure that you are familiar with and approve of the terms on which tools are provided by the relevant third-party provider(s).

We may also, in the future, offer new services and/or features through the website (including the release of new tools and resources). Such new features and/or services shall also be subject to these Terms of Service.

Please note that there may be specific orders we cannot accept and must cancel. At our sole discretion, we reserve the right to refuse or cancel any order for any reason. Some situations that may result in your order being cancelled shall include limitations on quantities available for purchase, inaccuracies or errors in product or pricing information, or any defect regarding the quality of the product. We may also require additional verifications or information before accepting any order. We will contact you if all or any portion of your order is cancelled or if additional information is required to accept your order. If your order is cancelled after your debit/credit card has been charged, the said amount will be credited back into your Card Account within 7 days.

We may monitor the user’s account to avoid fraudulent charges and transactions. Users with more than one account or availing of our services fraudulently shall be liable for legal actions under applicable law. We reserve the right to recover the cost of goods, collection charges and lawyers fees from persons using the site fraudulently. We reserve the right to initiate legal proceedings against such persons for fraudulent use of the site and any other unlawful acts or omissions in breach of these terms and conditions.

In the event of detection of any fraudulent/declined transaction, before initiation of legal actions, we reserve the right to immediately delete such account and dishonour all past and pending orders without any liability. For this clause, we shall owe no penalty for any refunds.

You agree and confirm that the debit/credit card details provided by you for availing of services on the site will be correct and accurate. You shall not use a debit/credit card you do not lawfully own, i.e. in a debit/credit card transaction; you must use your debit/credit card. You further agree and provide us with the correct and valid debit/credit card details. Additionally, the said information will not be utilised and shared with any third parties unless required for fraud verifications by law, regulation or court order. We will not be liable for any debit/credit card fraud. The liability for the use of a card fraudulently will be on you, and the onus to ‘prove otherwise shall be exclusively on you.

All trademarks, service marks and trade names of ITEE and (ITEE) used in the site are trademarks or registered trademarks of ITEE.

This site and materials and products are provided “as are” and without warranties, whether express or implied. To the fullest extent permissible under applicable law, itee.com disclaims all warranties, express or implied, including, but not limited to, implied warranties of merchantability and fitness for a particular purpose and non-infringement.

Itee.com does not represent or warrant that the functions contained in the site will be uninterrupted or error-free, that the defects will be corrected, or that this site or the server that makes the site available is free of viruses or other harmful components. Itee.com does not make any warrantees/representations regarding the use of materials on this site in terms of their correctness, accuracy, adequacy, usefulness, timeliness, reliability or otherwise. Some states do not permit limitations or exclusions on warranties, so the above limitations may not apply to you.

In addition to other prohibitions as outlined in the Terms of Service, you are prohibited from using the site or its content:

We reserve the right to terminate your use of the service or any related website for violating prohibited uses.

You agree to indemnify, defend and hold harmless ITEE and our parent, subsidiaries, affiliates, partners, officers, directors, agents, contractors, licensors, service providers, subcontractors, suppliers, interns and employees harmless from any claim or demand, including reasonable attorneys’ fees, made by any third party due to or arising out of your breach of these Terms of Service or the documents they incorporate by reference or your violation of any law or the rights of a third party.

Suppose any provision of these Terms of Service is deemed unlawful, void or unenforceable, in that case, such provision shall nonetheless be enforceable to the fullest extent permitted by applicable law. The enforceable portion shall be severed from these Terms of Service; such determination shall not affect the validity and enforceability of any remaining provisions.

The obligations and liabilities of the parties incurred before the termination date shall survive the termination of this agreement for all purposes.

These Terms of Service are practical unless and until terminated by you or us. You may terminate these Terms of Service by notifying us that you no longer wish to use our Services or when you cease using our site.

Suppose in our sole judgment you fail, or we suspect you have been unable, to comply with any term or provision of these Terms of Service. In this case, we also may terminate this agreement at any time without notice. You will remain liable for all amounts due up to and including the date of termination; and/or accordingly may deny you access to our Services (or any part thereof).

We may accept returns for account credit only. In case of a return, refund and/or exchange, you must contact us within 5 HOURS of receiving the product. Items must be unused, undamaged and must be returned in their original packaging. WE DO NOT PROVIDE REFUNDS ON ANY GOODS SOLD. Goods once sold can only be exchanged for replacement or store credit if they meet our terms and conditions. Since we keep limited inventory, under such circumstances, the amount you get back as account credit can be used WITHIN 3 MONTHS whenever you shop with us next time.All conditions applicable to the return of goods shall also apply to the exchange of goods. To return an item, the customer must write to us at (info@itee.co.in), and a prompt response is assured to such mails. We are not liable for any damages caused to the product during transit.

Orders placed on weekdays are dispatched within 24 – 36 hours, and orders placed on the weekend are shipped on the next working day within 24-36 hours. Please ensure you complete your address details correctly when placing your order. If you fail to take delivery of the goods, we, at our discretion, may charge you for the additional shipping cost.

You will receive an email receipt when you complete the purchase process from info@itee.co.in.

We are not responsible for any delays/cancellations caused by third-party delivery agencies and/or due to the time required for statutory clearances during the delivery process.

In such an event, we may not be able to deliver the confirmed order(s) as mentioned hereinabove. In case you have made the payment for such order(s) through your credit/debit card, the amount paid by you while placing the order(s) on the site will be credited to your card account within 7 days. No refunds shall be applicable on the orders made by the Users under the Cash on Delivery (“COD”) option.

Suppose a dispute arises between you and the Company during your use of the site or after that, in connection with the validity, interpretation, implementation or alleged breach of any provision of the agreement and the Privacy Policy or the documents they incorporate by reference. In that case, the dispute shall be referred to a sole Arbitrator who shall be an independent and neutral third party identified by the Company. The place of arbitration shall be Ahmedabad. The Arbitration & Conciliation Act, 1996, shall govern the arbitration proceedings. The arbitration proceedings shall be in the English language.

This Agreement and the Privacy Policy or the documents they incorporate by reference shall be governed and construed following the laws of India, with exclusive jurisdiction conferred on the courts in Ahmedabad.
